These terms cover the Step Gazelle app for iPhone and this website. In them, “Step Gazelle”, “we” and “us” mean Step Gazelle, the publisher of the app, and “you” means the person using it. Installing or using the app means you accept these terms. If you do not accept them, delete the app.
What the app is
Step Gazelle reads your step counts from Apple Health and sets a daily goal from your own recent history rather than from a fixed number. It shows your progress, keeps a streak, and draws a scene on the Home Screen widget.
It is a motivational tool and nothing more. Step Gazelle is not a medical device, and nothing in it is medical advice, a diagnosis, or a treatment recommendation. Step counts come from the sensors in your iPhone and from whatever other apps and devices write to Apple Health; they are estimates, and so is everything the app derives from them. Talk to a qualified professional before making a meaningful change to your activity, and do not use this app to manage a medical condition.
Goals, streaks and the record it keeps
Goals, streaks, passes and the history the app shows you are produced by the app from the data available to it at the time. A tracker that syncs late, an unreported day, or permission withdrawn in the Health app will change what the app sees and therefore what it tells you. We do our best to make these numbers honest, and we do not guarantee that any of them is accurate, complete, or preserved. Do not rely on them for anything consequential.
Health data and privacy
The app reads step data from Apple Health only with your permission, and it only ever reads: it never writes to Apple Health and never changes your health records. You can withdraw that permission at any time in the Health app. What the app stores, and where, is set out in full in the privacy policy, which forms part of these terms.
Your licence to use the app
The app is licensed to you, not sold. You get a personal, non-exclusive, non-transferable licence to use it on Apple devices you own or control, under the App Store rules that apply to every app, for as long as you comply with these terms. Apple's Licensed Application End User License Agreement applies as the baseline; these terms sit on top of it, and where the two conflict about the app itself, these terms govern.
You agree not to copy, redistribute, resell or sublicense the app, not to reverse engineer, decompile or attempt to derive its source code except where law expressly permits it, not to remove or alter any notice in it, and not to use it unlawfully or to interfere with it or with anyone else's use of it. The name Step Gazelle, the app icon and the artwork are ours; these terms give you no right to use them.
Premium
The app is free to download. Premium is a one-time purchase, not a subscription, tied to the Apple Account you buy it with, and it unlocks the premium features as they exist from time to time. The price you pay is the one the App Store shows you at the time of purchase.
Apple sells it, not us: Apple processes the payment, and the purchase is subject to Apple's own terms. Refunds are handled entirely by Apple, through Apple's request process at reportaproblem.apple.com. We cannot issue, approve or refuse a refund, and we have no access to your payment details.
If premium does not appear on a new device or after reinstalling, open Settings in the app and tap Restore purchase. If that does not work, write to us and we will help.
We may add, change or retire features over time, premium ones included. Where we retire something you paid for, we will aim to replace it with something equivalent rather than simply remove it.
Availability
We do not promise the app will always work, or always be available. It depends on iOS and on Apple Health, and on how iOS chooses to schedule background work: the widget updates in jumps for that reason, as the support page explains, and that is a platform limit rather than a fault. We may change, suspend or discontinue the app, or stop supporting an older version of iOS, at any time. Your own device backups are your responsibility.
Who may use it
You must be at least 13 years old to use Step Gazelle. The app is not directed at children, and it collects no personal information from anyone.
No warranty
The app and this website are provided as is and as available, without warranty of any kind. To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you, and nothing here limits rights you have as a consumer that cannot be waived.
Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, for lost data, or for any injury, illness or health outcome arising from your use of the app or from activity you undertook because of it. Our total liability for any claim relating to the app is limited to the amount you actually paid for it, which for a free download is nothing. Again, some jurisdictions do not allow these limits, and nothing here excludes liability that cannot lawfully be excluded.
Apple
Apple is not a party to these terms. Apple has no obligation to provide any support or maintenance for the app, and any claim about the app is between you and us rather than between you and Apple. Apple is a third-party beneficiary of these terms and may enforce them against you.
Ending the licence
You can end this licence at any time by deleting the app. We may end it if you breach these terms. Deleting the app removes its data from your device; premium remains attached to your Apple Account and can be restored if you install the app again.
Changes to these terms
If these terms change, the updated version will be posted here with a new date. If a change is significant we will say so in the app or on this site. Continuing to use the app after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Washington, USA, without regard to its conflict of laws rules. Any dispute that is not resolved informally will be heard by the state or federal courts located in Washington State, and you and we consent to the jurisdiction of those courts. If you live somewhere whose law gives you the right to bring a claim locally, this does not take that right away.
